Legal Question in Wills and Trusts in Texas

Kept in the dark about inheritance

My father died in 1989. There were 4 of us children from 1st marrage. My father had remarried and he and step mother owned and lived on large pecan farm. At the time of my father's death, my oldest brother said he was ''executor and the estate was to be maintained for the benenfit of my step mother.'' That's all we were ever told. My other two brothers and myself were never notified of any will probation, but assumed we were intittled to some form of inheritance. The exeutor Brother died in 2001. We believe my step mother, though elderly is still alive and possibly still lives on the estate. How do we find out if we were discluded from any information out of greed or if we are in fact still entitled to some time of inheritance? Is there legal information available to us before we decide to hire a lawyer? Does this sound like an expensive or hopeless quest on our part?

Re: Kept in the dark about inheritance

If your father left a will, and if the will was probated, that information would be available as a public record. The will would be probated in the county where your father lived.

If no will was ever probated, then you and your siblings could open his estate in probate as an application to determine heirship for muniment of title; who are the heirs only for purposes of ownership.

The probate may cost as much as $2,000; probably less.
