Legal Question in Wills and Trusts in Texas

death of seller

My aunt was in the process of selling a portion of her property when she died. She willed me her property ( I took care of her for the last 10 years of her life and her sons had nothing to do with her)and split all monies between her sons and me. I know the seller can force of the sell of the property but will I get all the proceeds or only a share.

Re: death of seller

If the contract for the sale of the house has not closed, then in all likelihood, the obligation to sell passes to your aunt's estate. The executor of her will would have to either finish closing the sale and have cash come into the estate or deed the property to you and let you close the sale.
