do you have to do a probate if you are the surviving spouse to sell home or cars

You will have to do a probate procedure, not necessarily full probate of will or lack. You might be able to do a muniment of title for the house and an affidavit of heirship for the car. If you don't know how to do this, you will need a lawyer. Good Luck.
