Legal Question in Wills and Trusts in Texas
If the deceased had a will, but NO estate (no property, no money in bank, no 401's, investments, etc. and lived with their adult child in childs home) would probate be necessary and who is responsible? This is in the state of Texas and deceased had credit card bill of $10,000 at time of death in their name only.

If there are no assets, there is no need for the heirs to file a probate proceeding.
