Getting deed to property of deceased parents
My mother and step-father both died without leaving a will. There is real property in there name that is paid off except for the back taxes that have incurred. How can I get the deed put into my name. I also have a brother and my step-father has a son. I live in Texas.

The other heirs will have to disclaim their legal interest or you will have to buy them out. You can then file for an affidavit of heirship to transfer the title. Good Luck.

Assuming there are no estate debts, you can file an heirship affidavit which will establish ownership in the heirs. The heirs can transfer their interests to whomever they choose by using warranty deeds.
