Default Judgement Arising From a Auto Accident/Personal Injury Suit

My brother-in-law, mother-in-law, and daughter were rear ended three years ago in an auto accident. The defendant (who was insured) was deemed responsible for the accident but did not respond to the summons and we have obtained a judgement against him. The attorney says the the suit is now in a ''discovery'' phase to determine whether the defendant has assets that can be seized. Since the defendant was insured isn't the insurance company liable? The attorney, who says he has given notice to the insurance company, says maybe not. How is that possible?

There may be any number of reasons. Ask the attorney who's handling the case. I can't speculate as to the actual reason.
