disbursing of funds

Can the money you borrowed from my father who just died be taken out of my part of the estate if there was never a contract and it was to be paid back when possible.

Hmmm. It is an argument you could make and the judge would decide. But the deeper issue is ethical. Ask yourself, "what is the RIGHT thing to do?"
