Legal Question in Wills and Trusts in Texas

Distributing pre-inheritance to siblings

My mother has been in a nursing home for about a year with severe dementia. She has income of about $200,000 a year from oil/gas royalties. I'm the POA and am about to have her home sold with a net of about 90,000. I was just going to deposit in a savings account in her name. But between 4 kids, everyone is asking for funds now instead of waiting until ''the day.'' Mom is well taken care of and her income is in a trust which her brother handles, but her home is hers personally and not part of her trust. I feel like it would be okay to give everyone maybe $10,000 now as maybe some kind of pre-inheritance but don't feel 100% comfortable. I know she wouldn't have a problem with it. The trust which she received when her parents passed will be distributed to us children when she dies, but it is to be used soley for her support and what ''she'' wishes. Thank you for your feedback.

Re: Distributing pre-inheritance to siblings

Does your Power of Attorney grant you the authority to make gifts? If it doesn't specifically grant that authority, then you shouldn't make the distribution.
