divorce and dying intestate

If a person dies intestate and is in the process of getting a divorce (all papers are signed and parties are in agreement with only one attorney ), with one minor child from the marriage, what are the surviving spouse's rights and child's rights to community property and life insurance?

There is NO divorce and unless there is a previous marriage with childen, the surviving spouse of this marriage takes all!
