i divorced my daughters father 5 years ago. he just passed away suddenly from an accident. who would be the next of kin his mother or the minor child?

You would need to have an applicant file for letters of administration in probate court. The applicant can either by you as next friend of the minor child, or the parent. Please call me to discuss.
