Can a drug addict be declared legally incompetent in the state of Texas

To answer your question, yes, a drug addict can be found to be legally incompetent. A non-drug user can also be found to be legally incompetent. It's an issue of fact, which means that a court would determine competency. Drug use, by itself, will not support a finding of incompetence.
