Legal Question in Wills and Trusts in Texas
How Do We Ensure that the right will was probated?
My grandmother recently passed and we have reason to believe that the executor is trying to file an older will with the court systems. How do we ensure that the one read by the probate attorney is the one submitted to the courts? Keep in mind that my grandmother had worded her will so that lawyers wouldn't have to get involved and the executor is very adament about trying to keep this out of the court system. The only thing I ask in this is that a generic answer such as ''hire and attorney'' isn't given. I understand that we'll probably have to hire an attorney, but I'm just wondering if there is a way to ensure that the right will is filed with the courts. Thanks!

You may not like it, but the real answer here is consult with an attorney of your own. If you are worried that the executor is going to commit fraud, you need professional help and you need it before things go much further.
