My father passed away and had no money left to pay some bills that were incurred by him. (credit cards, etc.) There was no property owned by him at that time either. Do I have to file anything in court, or am I or my brother liable for the bills?

Neither you nor your brother are responsible for your father's debts unless you co-signed for him. If he had no property there's no estate to probate. Any insurance he may have had passes by contract to the named beneficiary, and is not considered part of his estate.

Neither you nor your brother have to file anything.
