Legal Question in Wills and Trusts in Texas

Estate Mgt.

My son-in-laws father just passed away. He father was divorced and there are only two surving children, one of which is my son-in-law. There was no will or executor assigned and now he is left to try and secure enough of his fathers financial assets to manage the funeral cost. How does he gain access to the estate? His sister by the way is extranged and wants nothing to do with the arrangments for estate mgt.

Thanks, Renee

Re: Estate Mgt.

Your son-in-law needs to immediately contact an attorney to open up probate for an heirship proceeding. He is entitled to an inheritance, and thus is entitled to do so. My condolences on the loss of his father.
