Estate Protection for Minors

Minor children inherit a large sum of money. Does the parent they reside with have access to the money? or untouchable? Does it matter if the other parents family left the inheritance?

Generally, the court will appoint some appropriate person as a guardian of the estate for the minor children, and the guardian must make detailed reports as to what he or she does with the money. When the children reach the age of 18, they get the money. The parent only has the access the court allows them to have. It doesn't matter where the inheritance came from.

However, if the decedent made some other provision in his or her will about gifts to minor children, then that will govern. For example, there may be a trust set up. Or possibly the executor holds on to the inheritance until the children reach the age of 18.
