Legal Question in Wills and Trusts in Texas

estate question

My mother just passed away and she had my sister on her savings acct. as beneficiary. Her will states that every thing is split between the 3 children. Is that acct. subject to the division. Last yr she added my sisters name and her husbands name with her name to the land deeds, does the will that says everything is split 3 ways also still include the land and if so what percentage does my sister and her husband own.

It really sounds like you need to go sit down and have a talk with a good probate attorney. Normally accounts and policies that have beneficiaries pass directly to the named beneficiary, not through the Will. If your aunt's and uncle's names are on the deeds they are part owners (someone will have to review the deeds to determine how much they own) of the property and your Mom could only pass on what she still owned to you and your siblings.
