In Texas, there rarely is a formal "reading" of the Will. Typically someone, usually the executor, files in court to probate the Will. If he or she does not do so, then someone else can file it. Once an executor is appointed, that person has a "fiduciary" duty which is much stronger than most duties. If the executor does not properly administer the estate, including properly accounting for the estate, then the executor can be removed and even held personally liable for losses.
