Legal Question in Wills and Trusts in Texas

Executor

I am the executor for a my husbands will. He left money for 4 people in his will. I am the beneficiary of his insurance policy. His bank accounts were closed while he was ill so there are no other monies except 401k which I still need to inquire about. I believe that he had a beneficiary on his 401k. Do I have to file his will in probate?

If there's no titled property, such as real estate, and his insurance policy and 401K pass to the beneficiaries by contract, the only problem would be if he named his estate as his 401K beneficiary.

That would require a minor action in probate.
