if executor does not probate will, is there any penalty imposed upon him?

No. He can't be forced to act as executor; involuntary servitude has been abolished. If he DOES undertake to act as executor, he has to do it properly, though.

Sometimes there is no reason to probate. If an heir has a concern, the heir can hire an attorney to ask to be appointed executor.
