Legal Question in Wills and Trusts in Texas

Executor of a will

I have been informed by my exwife's sister, that I am the executor of my exwife's will ( she died in November 2006). I have never seen the will, and do not know how to go about getting a copy of it. Her son suppposedly has take over her property and has a copy but has not probated it. He has not been forthcoming about turning any information over to me

Re: Executor of a will

Under Texas law, if the will was drawn up before your divorce, the law will read the will as if you died before her. You would not be the executor if the will was pre-divorce.

If it was drawn up after the divorce, or you don't know when it was prepared, then follow David Leon's advice.
