Legal Question in Wills and Trusts in Texas

what do i do?

My exhusband died May 08, leaving 3 children under the age of 18. His grandmother died in March of 09. Just now finding this out, His family does not want me to know things. I last knew that the grandmothers will stated that her stuff (money, homes, belongings) was to be divided between my ex and his brother and sister. Since my ex is nolonger here would his portion go to his children? and Want do I need to do to find out what is rightfully the childrens? AND I am pretty sure that the family is keeping this from me becuase they are spending the money that the grandmother had. is the legal action that i should take to make sure that my children are not left out.

The probate file is a public record. You can go to the probate court and ask for a copy there. It should say what happens in the event that a beneficiary predeceases the testator. BTW, get an attorney to represent your children NOW if you think the family members are stealing the money.

You really need to quickly contact an attorney to protect your children's interest before it is too late. The attorney will need to enter an appearance or open probate.
