Legal Question in Wills and Trusts in Texas
Family member died without will
My brother died last week and did not have a will. His first of kin would be my fater who is 81 years old. He did not have much of an estate but does have a old car we need to sell or give away. He has two sisters. What do we need to do to have one of us be the executor of his estate so my Dad does not have to deal with anything?

I'm sorry to hear about your brother. As for what to do, if all he has is the car, you can transfer it to the heirs by using the affidavit of heirship located on the back side of the car's title document. If you don't have the car's title, you can get a reissued title from the county records office.

Not much of an estate????? If he had a house or other real property, you might have to convey it by miniment of title or small estate. If he just had personal property, it will cost more than it's worth to probate it. You can get an affidavit of heirship at DOT for the car.
