I'm sorry to hear of your father's passing. To answer your question, some of the property will belong to the children, and other property will belong to the surviving spouse. The specifics depend on whether the property is separate or community, and whether the property is real or personal. Your rights are not self-enforcing. Get a lawyer--NOW.
