Legal Question in Wills and Trusts in Texas

My father died without a will in Texas. He is a Texas resident. No surviving spouse. He has a house in Colorado but he owes what it is worth. No other assets. Do we have to go to probate court? Do we have to appoint a personal representative? Can we let the house go into forclosure and close all accounts with a death certificate?

I'm sorry to hear about your father. If there are no assets, then there's no reason for you to probate his estate (unless you think there may be other assets out there.) When you say "close all accounts" what do you mean? If they are debts, then maybe they'll go away. If they are assets (such as bank accounts) they will most likely not let you get access with just a death certificate.
