Legal Question in Wills and Trusts in Texas

My father died 7 years ago, In a will he left his business, his house and all belongings to his current wife, my step mother. Step mother has one daughter, from a previous marriage, not my dads.

Step mother was killed in a wreck a few weeks ago, and had remarried six weeks previous to her death another man.

No will was left. Do I have any claim on the estate,or does it go to step mothers new husband or her daughter?

The estate is in Texas and I live in Georgia.

If I do have claim what do I do?

No. Her assets will go to surviving children, but her surviving spouse will have a life estate in the house. This is exactly the reason that Trusts were created. Had your father created one that would provide for his children and his new wife, you would have been ultimately been taken care of.
