Legal Question in Wills and Trusts in Texas
My Father passed away and my brother is executor of the will. There are two commercial properties thatgenerate income and we both have equal interest. I asked if the estate has been settled and he says it is. I have gone to the courthouse and the Will is filed as public record but ther are no other filings. My question is If there is no deed of distribution does he continue to have power under the estate,to make decision since the the properties are technically still in the estate? Does he have to complete the distribution?

if you are in Texas...call his lawyer..and settlement of estates are not swift..if the will is probate there are many records..go to the probate court..and talk to your brother/the lawyer..
