Legal Question in Wills and Trusts in Texas
My father passed away couple months ago. No will. He and my mother(alive) have a home in Tx. If my mother passes can the state take the home? If she had state health insurance help in another state.

I'm not sure what you mean by state health insurance. Medicaid? Medicare?
There are instances where MediCAID (not MediCARE) will attempt to collect against estate assets through the Medicaid Estate Recovery Program (MERP) Your mom should speak with an estate planning attorney to minimize the impact, if she is planning on being on Medicaid in the near future.
