Legal Question in Wills and Trusts in Texas

Father passed away in texas.

My father passed away leaving myself and my step mom behind. He had no will. Can my step mom sign the rights to the paid for home he left behind? She doesnt want anything to do with it and would like to sign it over to me. Do we need probate or a lawyer? And what forms do we need to make this happen.

The answer depends on when he bought the house (and whether or not it was community property.) Because a house is a larger asset, it would be better to have a lawyer do this for you, in order to ensure that it is handled properly. Assuming the estate had no debts, then this is a fairly simple task.
