There may be several things that you need to do. All of them begin with locating a probate attorney in the area that your father lived in. When a person dies without a Will, their property passes in accordance with our laws of intestacy -- the Will that the state has written for your father. Ensuring the passage of title often requires an heirship proceeding, and depending on your father's assets and death, might also involve the appointment of someone to administer his estate. These are not tasks that you should even attempt on your own, and you should consult with a Texas attorney immediately to understand how best to move forward.

First, collect all the information you can get on your own:

1. Death certificate

2. Contact information for children, spouse, etc.

3. Lists of assets and liabilities.

Once you have these contact a probate lawyer. There are several different mechanisms you can employ to settle the estate. The appropriate tools are very fact specific, however.
