I'm sorry to hear of your father in law's passing. I do these kinds of cases daily. I will need the following information:

1. Did your father in law have a will?

2. If so, I need to see a copy of it. That will determine who gets the house. If not, Texas intestacy laws will apply.

3. Is there anyone living in the house now? Specifically, a surviving spouse?

4. Did your father in law have any other debts? Any other assets?

There are a few ways to go about addressing this situation. If he had a will, then an interested party (executor, beneficiary, creditor, etc.) can present the will to the probate court. If he didn't have a will, there are a number of options, but they are fact specific, and I wouldn't know which one to use without your answering the above questions.

Most probate attorneys (myself included) will discuss the case with you for free, in order to determine what needs to be done, time tables, etc. I suggest you contact a few, go with the one you like best. Please let me know if I can be of further help.

Dave
