Legal Question in Wills and Trusts in Texas

fathers death

my father past away in 2007, me nor my brother and sister were ever notifyed of his will or probate. he had remarried and made a new life and family. do we, as his first desendants have any rights to see his will or only my step mother? also how do we get a copy of his will? we have never been told anything sence his death. my stepmother has total control and has already remarried. what and where do I do and where do i turn to?

please help me

If the will was probated, go to the probate court where he lived at the time of his death..there may be no will and no probate if he gave all assets away before death.

If your father died without a will his children outside of the present marriage (that would be you and any others out there) would inherit all of his separate and community property - you will need an attorney to help you with this...pronto! If he had a will, it can be viewed at the probate court in the county of his residence at time of death. Sorry about your loss.
