An agreement among the father's heirs would be nice, but it isn't necessary, and may not even be fair. When a person dies in Texas without a Will, their estate passes to their heirs in shares determined by the legislature. Heirs are determined by the marital and family facts of the decedent, and an heirship proceeding or other similar procedure would be used to resolve your issue. You're going to need an attorney to assist you with this.
