Fathers Land

Dad passed away No will. My sister my Brothers 3 Children and myself are the only survivors. Sister lives in Dads home. Can she take over my brothers childrens part without me agreeing to it?

You own an undivided 1/3. She owns an ndivided 1/3. Your nieces/nephews each own an undivided 1/9. You may be able to force a partition and sale of the property, although your sister may have a legitimate homestead claim.

You will have to take some formal steps to get legal recognition of your claim to the propety.
