My Father's Will

My father passed away last December with a will naming my mother as sole beneficiary. She has received all insurance benefits, Federal Pension and Social Security that was due to her. She still lives in their home, which is in her name, as well as my late father's name. Everything has gone smoothly since his death. I was recently told by a friend whose father also passed away, that my father's will must be probated by the court. Is that the case? What happens if we never have the will probated, and then my mother passes away? She has a will leaving her entire estate to her five daughters equally. I want to make sure we are doing everything properly and legally, since my father was so careful and precise in having all of his papers in order before his death. Thanks for your help.

Probating your father's will before your mother dies will save both estates a fair amount of money. Speak with a probate attorney to see whether the estate requires probate with administration or simply probate for muniment of title.
