Legal Question in Wills and Trusts in Texas

Followup Question About Filing to Become Executor

''For a probate case in Brazoria County, Texas. The current executor has asked the court to resign. I have volunteered to be the successor executor and the current executor supports this. I need the exact forms that I need to submit to the court to apply to be the successor administrator. Anyone have the form or can otherwise assist me?''

The case is already probated but needs to finalize. This is what I need from an attorney.

1. File to make me Executor.

2. Then we will create a Trust per the Will for the beneficiary.

3. Then we will file an Heirship determination with the court to finalize the beneficiary and transfer all assets to the Trust.

4. Then close the probate case with the court.

If an attorney that serves Brazoria County can help me do this for $150/hour, then I will hire you. If not, I sure would love a form so that I can atleast file to be administrator myself to get the ball rolling and then get an attorney later. My Email is surfsiderentals at gmail dot com. Thanks in advance for everything.

Still think you need the attorney first and the substitution second. Good luck!
