Legal Question in Wills and Trusts in Texas
Giving up a life estate interest in property
My step father has remarried and moved out of my mother's home (which she owned prior to their marriage). My mother died without a will and he had been living in the house with his life estate interest (in Texas). He has remarried, moved out and told us he is giving up his life interest. Do we need to have legal documents drawn up and signed by him stating this?

Re: Giving up a life estate interest in property
Step father would need to execute a deed of his interest (be it a life estate, or a life estate plus a remainder interest).
