Legal Question in Wills and Trusts in Texas

My grandfather died in 2010 without a will. My grandmother died 4 months after he did. We recently found out there is a check in the Texas Unclaimed Property database that belonged to him that is worth almost $26,000. How do we go about obtaining this check without a will? My mother is the eldest child of 4 children. There has already been squabbling over things that belonged to my grandparents and she is trying to keep that from happening now without having to spend an arm and a leg. The check is from an insurance claim that their mortgage company would not sign off on and the insurance company kept sending the check anyway. The property they owned was foreclosed on and sold so there should not be anything left owed on it. We live in the state of Texas and so did my grandparents.

See a lawyer about opening estates for each of them. If the property was foreclosed upon there may be a still be judgment against them. If there is you can find out the amount. The creditors will still have to be paid. Depending upon whether there is a judgment and the size, it may not be worthwhile.
