Legal Question in Wills and Trusts in Texas

My grandfather passed away in Upshur County, Texas in September 2006. My aunt is the administrator of his Living Trust. To my knowledge, a copy of this Living Trust has not been provided to any member in my family, nor have funds/property been dispersed. I can also find no record of it being probated in either Upshur County (place of death) or Gregg County (place of residence at time of death). I live in Washington state, the administrator now lives in Oregon. She is receiving mail from a bank in Gilmer, Texas with only my grandfather's name on it. How do I go about obtaining a copy of this Living Trust?

Ask your aunt. The purpose of a living trust is to avoid probate and it will not be of record. As an heir to your grandfather's estate, you can hire an attorney to open probate in Upshur county to probate your estate. In the meantime, a strong letter to your aunt from a lawyer might prompt her to put the cards on the table. Find a probate lawyer in Upshur County at the location of the county seat.
