Legal Question in Wills and Trusts in Texas
My grandmother nevered married my papa Frank, but were together for over 45 years as a couple. Only lived together when he was ill, so she took care of him. He passed away 2 years ago after being in bad health for several years.We recently found out his Will had not been read yet. He always told my grandmother in gratitude for taking care of him, someday he would take care of her - in his Will. She was a big part of his family's life and yet no one ever ask about how she is doing or even calls. My papa was not in any way a rich man, but living with his mom until she died, he probably had some money and living on a farm he has land. My grandmother is 90 and we think the family is waiting for her to die before reading the will, just so they don't have to give her anything. Is there a way I can find out if she is in the will - we don't know the attorney who drew it up.

There is a very easy court action that can require the estate, executor, or other persons who have knowledge of the will to take it to the courthouse for filing. This is very simple and only requires one document to be filed at the court and sent by certified mail to the known parties above. The judge will then order these people to show up in court with the original of the will at a certain date and time. It would be worth a little money to hire an attorney to do this for you just to make sure that she is not entitled to anything in his estate.
