How to handle son living in deceased foather's home during Probate process

Our father died and we are starting the probate process. It likely will take 90 days to officially be in a position to disperse the estate. A brother is living in the house now but we would like him out so we can process the real estate and assure no items will be take. How can we do this? He is resisting doing this until he receives some of the estate..

The executor (if there's a will) or the administrator will have to handle that situation.
