Legal Question in Wills and Trusts in Texas

Am I still an heir

I am an only child. My father passed away in 1995. My stepmother never probated his will. My stepmother passed away in Novemebr 2005. The will was written before my father passed away. I was told if he passed 1st, my stepmother got everything, and after her death, her sister got everything. If my stepmother went 1st, it went to my dad, then me.

I have not heard from the sister or her lawyer. She lives in New York. She has been to Texas twice. She is coming back in a month to to get items out of the house that she wants.

I need to know if I have any legal rights, at least to my dad's items.

You may be, and would be if your father passed away without a will. Check with the probate court or courts in the county where your father lived to see if his estate was ever entered into probate. If so, you should have access to his Will that was filed, and see if you've been told the truth.

If it hasn't been entered into probate, hire a lawyer that handles estate disputes ASAP.
