Legal Question in Wills and Trusts in Texas

Heirs and Survivorship Rights

My Dad died in Jan. 2005 due to complications due to illness, including Mesothelioma. He has many children. His caregiver, who was also his exgirlfriend from many years ago told my mother that prior to my dad becoming sick and hospitalized, he had listed all of us as his survivors on the settlement forms issued from the Law firm representing him and his case.

According to her, he wanted to do it so that we would be included should something happen to him.

However, when we got a copy of his Will, she was the executor and only beneficiary named. And in case of her death, her son would become the beneficiary. I have tried to contact an attorney for probate but have been very unsuccessful. The one I had to challenge the Will, decided a year later he couldn't do the case and gave me 2 wks to find another.

For everything I sought to challenge I can prove, including the duress when she took him to get it signed.

It was because her son, his other caregiver was being sent to prison. He was sentenced a day or so before she drove my dad to get his Will was done. She had extreme conflict of interest in his property and money she said she loaned him too. Can you please direct me to someone who can help with this matter asap? Thanks.

Re: Heirs and Survivorship Rights

These cases are very time consuming, very emotional, documents, expert testimony, witness testimony, i.e. very expensive. Where is your case located - in TX or AZ? Contact me by return email if you want to discuss this further.
