Legal Question in Wills and Trusts in Texas

Heirship vs will

My sister says we do not have to

probate mom's will but that an heirship

with all 4 kids listed will suffice. I am

listed as exec in the 1978 will we know

there was a later will naming six & I

co-execs but we cannot find the signed

will. What would be best way to

proceed?

If all children split equally and are the only heirs at law. The affidavit of heirship should suffice.
