home no will didnt probate
my mother passed away in 90. no will and i didnt probate her home witin 4 yrs. as i didnt know to do this.i have one broter and we thought the house just went to us.there are a few yrs of taxes too. please tell me what i can do now. have we lost the house? where do we start to get the house out of our mothers name?

You may have a few options, depending on what is left of your mother's estate. If the only thing there is the homestead, then you may be able to get by with an heirship affidavit, signed by the surviving heirs and filed in the county real property records.
If there is other property that you didn't take car of (such as a bank account) then we can do a small estate affidavit to clear that out at the same time.
Again, this depends on the family makeup, and the status of the estate.
