Husband died from cancer without will

My husband has 1 son. One of the Abestoes attorneys said they have funds to disburse. Because they have heard back from the son. He called them right before my husband died, and they have a current address. Because they have not heard back from the son t they said I need to go to the court and file probate. What does this mean and what do I do?

It sounds like they want to give the responsibility of handling the money to you. You should consult with an attorney to see whether you will need to file a probate or an administration. These asbestos funds will belong to your husband's estate, and they will be used to pay any court or legal fees. Depending upon the terms of the will or the family structure, you may also be entitled to some of these funds. If there are limited funds, you might want to consult with your attorney about whether the available funds will be sufficient to justify filing a probate or administration. If not, your attorney can talk to the asbestos attorneys to see if there is some less expensive method to get the funds disbursed.
