For starters, if your husband didn't have a will, then you only get a share of his property, and the children get a share. If you bought a home together, you only have your 1/2 community property interest in the home. If you want it in your name, you will need for the children to sign their interests over to you via a deed. You'll also need to clear title with an heirship affidavit.
