Legal Question in Wills and Trusts in Texas

My husband recently passed away. He has a checking account with a balance. I am not a authorized signer on the account. The bank says I need a Power of Attorney to gain access to the account. I know I can download a form from your website but what is the next step? Do I need to hire an attorney to fill out the form for me?

A power of attorney is revoked upon death. Clearly the bank has no idea. Depending on how much money is in the bank account and if your husband left a will, will determine what course of action you need to take. You should contact a lawyer in your area who deals in probate matters.
