Legal Question in Wills and Trusts in Texas

My husband recently passed away and was still in the process of getting his registration and license in Texas. Someone told me that he has not been in Texas long enough to be considered a resident. His children told me I need to get a probate lawyer in Texas and that everything we had will be divide between the 6 of us because he had no will in place. Do I need to get a lawyer in Texas or Rhode Island? Are they really able to take everything?

You need to contact an attorney in your county in Texas. Many will offer a free initial consultation. Probate may or may not be necessary. Are the children born outside of the marriage? If no will and if you own a house, you get a life estate in his portion of house and they get the remainder, Other property is divided according to the laws of intestate succession.
