Legal Question in Wills and Trusts in Texas

Husbands does not want to do a will

My husband does not want to do a will. I am getting ready to do mine. My question is ... If he does not leave a will Does half of the house that he and his mother own together go to her? I was also told that she will end up with 3/4 of the house and I would get 1/4 of it. I am not sure were to find the information on this.

Thank you Connie

You may be in a stick situation with the house. You have a community property interest in the house regardless of whose name is on the deed. You might need a lawyer to make that claim. You would have at least a life estate interest in the house for as long as you could maintain it and pay the taxes. You might want to confer with a lawyer on this if this subject is important to you.
