Legal Question in Wills and Trusts in Texas

Inheritance for adult children of prior marriages

Husband and wife each have children from previous marriages but none between the two of them. Land was purchased using inheritance the wife received from her mother's estate. The husband has passed away and we do not know if the land becomes soley the wife's or would the husband's children be entitled to half? There is no will and all the children were adults at the time the land was purchased.

Re: Inheritance for adult children of prior marriages

The land would be considered the wife's separate property, unless she put her husband's name on the deed as well. In that situation, she would have made a gift of one half of her separate property.

See our website at www.bradie-law.com for the distribution of property under Texas law when one spouse dies without a will.
